Sidepilot, Inc. — Terms and Conditions

Welcome to Sidepilot! These Terms and Conditions (“Terms”) govern your use of Sidepilot, Inc.’s (“Sidepilot,” “we,” “our,” or “us”) services, including our software platform designed to help small businesses manage leads, schedule classes, communicate with clients, and run automated campaigns. By accessing or using Sidepilot, you agree to these Terms.

If you do not agree to these Terms, please do not use our services.

1. Services Provided

Sidepilot provides software for small businesses, including but not limited to:
	•	Lead Management: Collect, segment, and nurture leads.
	•	Client Management: Schedule classes, track client interactions, and manage communications.
	•	Marketing Automation: Run automated campaigns via SMS, email, and other channels.
	•	Third-Party Integrations: Connect with platforms like Meta and Google to collect and manage lead information.

2. Account Registration and Responsibility

	•	You must provide accurate, complete information when creating an account.
	•	You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.
	•	Sidepilot is not liable for any loss or damage arising from unauthorized use of your account.

3. Data Privacy and Security

	•	Data Collection: Sidepilot collects and processes customer and lead data to provide its services.
	•	No Data Sales: Sidepilot does not sell customer data to third parties.
	•	Security Standards: Sidepilot follows industry-leading practices to ensure the confidentiality, integrity, and availability of your data.

4. Messaging Consent and Opt-Out

	•	Explicit Consent: Customers must obtain explicit consent from leads and clients before messaging them through Sidepilot.
	•	Opt-Out Management: Recipients can opt out at any time by replying STOP to SMS messages or by contacting support@sidepilot.com.
	•	Compliance: Users must comply with applicable messaging laws and regulations, including the TCPA and CAN-SPAM Act.
  
Agreement to Receive Text Messages
By providing your mobile number, you agree that Sidepilot and its customer may send you
periodic SMS or MMS messages containing but not limited to important information,
updates, deals, and specials.
● You will receive up to 50 messages per month.
● You may unsubscribe at any time by texting the word STOP to the number from which your receive messages. You may receive a subsequent message confirming your opt-out
request.
● For help, reply to any message with the word HELP.
● Message and data rates may apply.
● United States Participating Carriers Include AT&T, T-Mobile®, Verizon
Wireless, Sprint, Boost, U.S. Cellular®, MetroPCS®, InterOp, Cellcom, C
Spire Wireless, Cricket, Virgin Mobile and others.
● T-Mobile is not liable for delayed or undelivered messages.
● You agree to notify us of any changes to your mobile number and update your
account with us to reflect this change.
● Data obtained from you in connection with this SMS service may include your
cell phone number, your carrier’s name, and the date, time and content of
your messages, as well as other information that you provide. We may use
this information to contact you and to provide the services you request from
us.
● By subscribing or otherwise using the service, you acknowledge and agree
that we will have the right to change and/or terminate the service at any time,
with or without cause and/or advance notice.

Though Sidepilot and its customers will never charge you for the text messages you receive,
depending on your phone plan, you may see some charges from your mobile
provider. Please reach out to your wireless provider if you have questions about your
text or data plan.  

5. Third-Party Integrations

	•	Sidepilot integrates with third-party platforms (e.g., Meta, Google) to enhance service functionality.
	•	Sidepilot is not responsible for data handling or policies of third-party services. We recommend reviewing their terms and policies separately.

6. Acceptable Use

Users must not:
	•	Use Sidepilot for illegal, abusive, or harmful activities.
	•	Misrepresent your identity or collect lead data without consent.
	•	Attempt to bypass Sidepilot’s security features or access unauthorized data.

Violation of this section may result in suspension or termination of your account.

7. Support and Contact

	•	Support: For any issues, questions, or account changes, contact us at support@sidepilot.com.
	•	Unsubscribe Requests: Users can unsubscribe from email and text communications by replying STOP to messages or emailing our support team.

8. Limitation of Liability

Sidepilot is not liable for:
	•	Indirect, incidental, or consequential damages.
	•	Losses arising from third-party service failures or your misuse of our platform.

Our liability is capped at the fees paid for the service in the past 12 months.

9. Modifications to Terms

We may update these Terms from time to time. We will notify you of significant changes, and your continued use of Sidepilot constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the United States of America, without regard to conflict of law principles.

11. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Sidepilot regarding the use of our services.
